Terms & Conditions

1. Who you are contracting with

The Librythm service ("Librythm", "the service") is provided by YVY - DO BETTER, LDA, a company established in Portugal ("we", "us", "our"). By creating an account or using Librythm you enter into a binding agreement with YVY - DO BETTER, LDA.

2. Acceptance

By accessing, creating an account on, or continuing to use Librythm, you agree to these Terms & Conditions and our Privacy Notice. If you do not agree, do not use the service. You confirm that you are at least 16 years old (or, if using on behalf of an organisation, that you have authority to bind it).

Librythm helps you scan, organise, and track your physical book collection, take notes, log reading sessions, and view insights. Some features (such as AI search, larger libraries, and family sharing) are only available on paid plans.

Librythm includes AI-powered features (such as AI search across your notes and library). You agree:

You retain ownership of the content you add to Librythm (books, notes, highlights, etc.). You grant us a limited, worldwide, royalty-free licence to host, store, transmit, and process your content solely to provide the service to you and your authorised family members.

8. Intellectual property

We retain all rights, title, and interest in and to the Librythm software, branding, design, documentation, and any related intellectual property. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.

9. Payments, subscriptions, and Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing, taxes, payments, refunds, and chargebacks, and handles returns.

Payment, billing frequency, taxes, currency conversion, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms and our Refund Policy. Subscriptions renew automatically at the end of each billing period unless cancelled. You can manage or cancel your subscription at any time via paddle.net or from your Librythm profile.

10. Free trial

We may offer a free trial of paid features. At the end of the trial you may subscribe to a paid plan; otherwise paid features become unavailable while your existing data remains accessible on the free tier where applicable.

11. Service availability

We work hard to keep Librythm available and reliable, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue features at any time.

12. Suspension and termination

We may suspend or terminate your access to the service if you materially breach these terms, fail to pay applicable fees, pose a security or fraud risk, or repeatedly violate our acceptable-use policy. You may close your account at any time from the profile page or by contacting support. On termination you may export your data for 30 days, after which it will be deleted in line with our Privacy Notice.

13. Warranties and liability

To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the service shall not exceed the fees you paid to Paddle for Librythm in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or for any other liability that cannot be excluded by law.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your content, your unlawful use of the service, or your breach of these terms.

15. Governing law

These terms are governed by the laws of Portugal. Disputes shall be subject to the exclusive jurisdiction of the courts of Amarante, Portugal, without prejudice to mandatory consumer-protection rights you may have where you live.

16. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after the effective date of an update constitutes acceptance.
